Terms and Conditions for “3-Star Integrity Quest: Accuracy Confirmation” Campaign (Round 2)
1. Introduction
These Terms and Conditions apply to participants (“Participants”) in the “3-Star Integrity Quest: Accuracy Confirmation” campaign (Round 2) (“Campaign”) organized by Precious Coin Tester (“Organizer”). By participating in the Campaign, Participants agree to be bound by these Terms and Conditions.
2. Eligibility
- Participants must be users of the Precious Coin Tester app.
- Participants must be 18 years of age or older.
- Employees of the Organizer and their immediate family members are not eligible to participate.
3. Campaign Period
The Campaign begins on November 1, 2024, and ends on June 30, 2025, or when a false positive is confirmed and rewarded, whichever comes first.
4. Participation Process
- Participants must use the latest version of the Precious Coin Tester app (version 2.0.11 or higher) for testing coins.
- If a Participant suspects a 3-star result is incorrect, they must follow the reporting and verification procedures as outlined in the Campaign communication.
5. Rewards
- A $100 (USD) or equivalent reward will be given for the first confirmed false positive.
- The reward will be paid minus any applicable bank transfer fees.
- The decision of the Organizer regarding reward recipients is final and binding.
6. Destructive Analysis Consent
- To reveal the exact precious metal content, a destructive analysis using potentiometric titration or an equivalent method will be conducted by a third party.
- Participants acknowledge that the assay analysis of the coin in the final step is a destructive process, and the coin will not be returned.
- By physically sending a coin to the Organizer for analysis, Participants irrevocably consent to the destruction of the coin.
7. Property Rights
- Physically posted coins become the property of the Organizer and will not be returned under any circumstances.
- Participants confirm they have the legal right to dispose of the posted coin.
8. Intellectual Property Rights
- Ownership of Submissions: Participants acknowledge and agree that any materials, including but not limited to photos, videos, or written content, submitted to the Organizer as part of the Campaign become the property of the Organizer.
- Right to Use: By submitting any material, Participants grant the Organizer an irrevocable, perpetual, worldwide, royalty-free, and non-exclusive license to use, reproduce, modify, publish, translate, create derivative works from, distribute, and display such material in any media.
- Warranties on Submissions: Participants warrant that they own or have the necessary licenses, rights, consents, and permissions to use and authorize the Organizer to use all intellectual property rights in any submissions, and that these submissions do not infringe the rights of any third party.
- No Obligation to Use: Submission of material does not create an obligation for the Organizer to make use of any rights provided in these terms.
9. Data Privacy
- Participants’ personal information will be used only for purposes related to the Campaign.
- Winners may be announced publicly, with disclosure limited to partial email, initials, or region, based on the winner’s preference.
- Partial email example: j***h@e***e.com for james.smith@example.com
- Initials example: JS for James Smith.
- Region example: North America, South Europe, etc.
10. Limitation of Liability
- Compliance with Consumer Rights: Nothing in these Terms and Conditions will:
- limit or exclude any liability for death or personal injury resulting from negligence;
- limit or exclude any liability for fraud or fraudulent misrepresentation;
- limit any liabilities in any way that is not permitted under applicable law; or
- exclude any liabilities that may not be excluded under applicable law.
- General Limitation: The Organizer shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) the Participant’s access to or use of or inability to access or use the Campaign; (ii) any conduct or content of any third party related to the Campaign; (iii) any content obtained from the Campaign; and (iv) unauthorized access, use, or alteration of Participants’ transmissions or content.
- Participation Responsibility: Participants agree that they participate in the Campaign at their own risk and that the Organizer is not responsible for any personal injury or property damage, or any other loss, claim, damage, or liability that may arise from participation.
- Force Majeure: The Organizer is not liable for any failure to perform its obligations under these Terms and Conditions where such failure results from any cause beyond the Organizer’s reasonable control, including, without limitation, mechanical, electronic, or communications failure or degradation.
11. Miscellaneous
- The Organizer reserves the right to modify, suspend, or terminate the Campaign at any time without prior notice.
- Any disputes related to the Campaign will be resolved by the Organizer at its sole discretion.
12. Governing Law
- These Terms and Conditions are governed by the laws of France.
13. Acceptance of Terms
- Participation in the Campaign constitutes acceptance of these Terms and Conditions.
